Campingzeit am Rätzsee GmbH - Booking Terms and Conditions

This English translation of the General Terms and Conditions of Campingzeit am Rätzsee GmbH is intended exclusively as non-binding information for our guests. Only the original German version of these General Terms and Conditions is legally binding.
1. Conclusion of a contract
The lessee's request for reservation is a binding offer to the lessor of the accommodation or pitch, Campingzeit am Rätzsee GmbH. The request can be given in written form or verbally, also via telephone.
For the lessor the contract is only binding once it has been confirmed by him in written form.
In case of differences between the lessor's confirmation and the lessee's application, the confirmation constitutes a new offer which is binding for the lessor for ten days. The contract on the basis of the new offer is binding for both parties if the lessee gives his approval within ten days.
The contracting parties are Campingzeit am Rätzsee GmbH and the customer. If a third party has ordered for the customer, he is liable to Campingzeit am Rätzsee GmbH together with the customer as joint debtor for all obligations arising from the contract. According to German law the lessor is not a tour operator, and there is no travel contract being concluded. The only main product offered by the lessor is the accommodation. Further services are only of minor importance.
2. Prices
The prices for accommodation, pitches and operating costs are listed in the lessor's price list. The lessor will confirm them in written form. The invoice total is the agreed price which will not be reduced if the actual stay is shortened.
If the lessee is eligible for discounts, only the highest discount rate will be accepted by the lessor. Discounts cannot be accumulated.
Any discount card accepted by us must be valid at the time of the booking and of the actual stay, and the card must be presented upon arrival. A later recognition of the discount is not possible.
3. Payment
3.1) Camping Pitches
EUR 70,- are due to be paid by the lessee to the lessor on receipt of the booking confirmation, at least within 7 days. The rest has to be paid 14 days before arrival. Invoice totals of less than EUR 130,- and short-term reservations are due immediately.
3.2) Accommodation (holiday apartment, caravan for rent)
30 % of the invoice total is due to be paid by the lessee to the lessor on receipt of the booking confirmation. The rest has to be paid 6 weeks before arrival. Invoice totals of less than EUR 130,- and short-term reservations are due immediately.
3.3) Delay of Payment
The due dates will be printed on the lessor's confirmation. Punctual payment is important to have a safe reservation. In case of delay of payment by the lessee of more than seven days, the lessor reserves the right to cancel the reservation without further notice. The lessee will be charged fees as defined in paragraphs 7.1 and 7.2 of this contract.
3.4) Bank details:
All payments are to be made to the account stated in the booking confirmation and below.
3.5) Additional costs
Additional cots, e.g. for electricity or warm water, are due one day before departure.
4. Arrival and Departure
The booked pitch/accommodation is available for the lessee after 3 p.m. on the date of arrival. There is no entitlement to earlier occupancy. On the day of departure, pitches have to be abandoned before 11 a.m. and accommodations before 10 a.m. Thereafter, Campingzeit am Rätzsee GmbH may charge 50% of the full price for the additional use of the property until 3 p.m. in addition to the resulting damage, and 100% from 5 p.m. onwards.
The gates of the camping park are closed between 1 p.m. and 3 p.m., thus no arrivals and departures will be accepted during that time.
5. Deviation/rework
We reserve the right to deviations in the size of pitches and in the true-to-scale conformity of our site map. If due to unforeseen circumstances, the booked pitch is not available on time, the lessee will grant the lessor a prolongation until 6 p.m. If the problem is not solved until then, the lessor will offer the lessee another pitch of the same category or better. It the lessee is not satisfied with the substitute, he can cancel the contract without any charges. No further claims of the lessee will be accepted.
6. No-show/late arrival
In the event of a significant delay in arrival, the lessee needs to inform the lessor about the delay. Otherwise the pitch will only be available until 11.00 a.m. of the following day. Pitches/Accommodations that are not occupied by 11 a.m. the day after the reservation's arrival date, and where no agreement of late arrival has been set, can be used by the lessor on his own discretion. This also applies to pitches/accommodation that has become available due to early departure. If there is a delay in arrival, the lessor can offer the lessee a different pitch or accommodation, if available, but there is no legal claim any more to get a pitch/accommodation.
7. Cancellation
Reservations can be cancelled before 6 p.m. on the arrival date without giving any reasons. To avoid misunderstandings cancellations are only accepted in written form.
In case of late cancellation or non-arrival the complete invoice total will be charged.
If in case of short-notice cancellation, late arrival or early departure the accommodation can be let at the same conditions, the lessee has to accept an adequate fee for additional expenses of the lessor of 10 % of the proportional price, minimum EUR 60,-. A fee of EUR 10,- will be charged for changes of booking.
The lessor charges the following fees for cancellations:
7.1. Camping Pitches
- Up to 14 days before the arrival date: EUR 30,-
- 13 days before the arrival date until 6 p.m. on the arrival date: EUR 60,-
- After 6 p.m. on the arrival date: the complete invoice total
7.2. Accommodations
- Up to 90 days before the arrival date: 10 % of the invoice total
- 89 days to 45 days before the arrival date: 30 % of the invoice total
- 44 days to 30 days before the arrival date: 50 % of the invoice total
- 29 days to 2 days before the arrival date: 80 % of the invoice total
- 1 day before the arrival date or later: the complete invoice total
7.3. Reduction of fees:
The charged compensation for loss of rent and additional costs (see 7.1 and 7.2) can be reduced if the accommodation is re-let or costs for the lessor are reduced.
Travel insurance for the lessee is recommended.
8. Special Conditions for Accommodation
8.1. Deficiencies / deposit:
A deposit of 50,00 € is to be paid upon arrival when receiving the keys. The lessee will check his accommodation, the inventory and all other objects on his arrival and report all possible deficiencies the same day to the reception. We want to provide you with good service, and we need your help to do so.
8.2 Liability of the lessee:
The lessee has to treat all accommodation and all objects within with care. The lessee will be charged for all damages and/or losses occurring during the lessee's stay. The lessee is also responsible for all other members of his party.
8.3 Cleaning:
The lessee is responsible for cleaning the accommodation during his stay. If desired, this service can also be booked in addition. On departure, the lessee has to be tidy and clean the accommodation before it is handed over to the lessor. This includes: vacuum cleaning / sweeping the floor, washing the dishes, the cooking pots, the cutlery, the oven / microwave (if available) etc., emptying and cleaning the refrigerator, disposal of the rubbish and recyclables (glass waste, plastic). After your departure, our staff will take care of the following: Cleaning of windows, doors, furniture, seating yarn, wet-cleaning as well as general cleaning.
8.4 Handover / Refund or retention of deposit:
The lessee has to set a date and time for the check of the accommodation upon departure with the reception one day before departing. The accommodation and the keys have to be officially returned by the lessee before departure after the cleaning that has to be done by the lessee.
The accommodation must be handed over to the lessor before 10.00 a.m. on the day of departure. The deposit will be returned if the accommodation is properly left behind and all debts have been paid. It will be remitted to the lessee immediately after departure.
In case of damages, missing inventory or insufficient cleaning by the lessee, the lessor may remit only parts of the deposit or keep it in full and charge further costs. Further costs are due immediately.
9. Rules and Regulation of the Camping Park
The lessee and all members of his party have to adhere to the rules and regulations of the camping park, e.g. concerning the quiet periods of the day. These rules are announced on the notice board of the Camping Park, an English version is available at the reception. In case of violation of the rules and regulations, the lessor may cancel the contract without further notice and the lessee has no right to claim back any payments made in part or as a whole.
9.1. Visitors:
All visitors must register at the reception. Only the registered persons may use the camp site.
9.2 Driving motor vehicles on the site
Driving is only allowed for vehicles registered at the reception. Driving is not permitted during closing times of the barrier, i.e., between 1 p.m. and 3 p.m. and between 22 p.m. and 7 a.m.
10. Liability
Every guest is obliged to treat the inventory and the pitches with care. He is also obliged to reimburse any damages caused by him to the lessor. Campingzeit am Rätzsee GmbH is not liable for damages or losses incurred by the guest, his relatives or his visitors, unless there is deliberate or grossly negligent behaviour on the part of the lessor or his vicarious agents.
11. Data protection
The customer agrees that his personal data collected in the course of customer service may be stored in our EDP system and automatically processed. Both contracting parties shall observe the relevant provisions of the Data Protection Act during the contractual relationship as well as after its termination. 12. Mistakes
The lessor reserves the right to correct printing, calculations and other mistakes.
13. Adjustment of Prices
All prices are based on the currently applicable VAT rates. If a VAT rate is increased or if tax-exempted turnover becomes taxable before our service is delivered, the lessor will claim the lessee to adequately compensate for the changed amount of the VAT rate. This is true even if the contract is already concluded more than four months before the change of law comes into force. In case of the introduction of tourist taxes or other the lessor reserves the right to adjust his prices accordingly.
14. Group trips / boat rental / naturism
Special conditions apply for group trips as well as for boat rental and guided tours. We encourage all guests, groups as well as families and single travellers, to practice naturism on the whole site. Nudity is mandatory on and around the beach.
15. Place of Jurisdiction
For traders, persons without legal domicile in Germany and persons that moved their legal domicile outside of Germany after contract conclusion, or persons of which their current place of residence is unknown at the time of action at law, as well as passive cases, the place of jurisdiction is the seat of the company Campingzeit am Rätzsee GmbH.
